General booking conditions
Article 1 : This seasonal rental contract is reserved for the exclusive use of the Gîtes du Couesnon.
Article 2 – Duration of the stay : The signatory tenant of this contract concluded for a determined duration will not be able under any circumstances to prevail himself of an unspecified right to maintain in the places at the end of the stay.
Article 3 – conclusion of the contract : The reservation becomes effective as soon as the tenant has validated the terms of the rental contract sent during the payment procedure.
The rental agreement concluded between the parties to this contract may under no circumstances be transferred, even partially, to third parties, whether natural or legal persons, without the written agreement of the owner.
Any infringement of this last paragraph could lead to the immediate termination of the rental at the expense of the tenant, the proceeds of the rental remaining definitively acquired by the owner.
Article 4 – absence of withdrawal: For reservations made by mail, telephone or internet, the tenant does not benefit from the withdrawal period, and this in accordance with Article L121-21-8 of the Consumer Code relating in particular to the provision of accommodation services provided at a date or according to a specific period.
Article 5 – Cancellation by the Tenant: Any cancellation must be notified by registered mail
a) Cancellation before arrival
It is possible to cancel with a full refund 15 days before the start of the rental period, 50% of the rental amount for a cancellation between 15 days and 48 hours . If a lockdown procedure occurs and prevents the tenant from taking possession of the property, the refund is full.
If the tenant does not show up within 24 hours of the arrival date indicated on the contract, the present contract becomes null and void and the owner can dispose of his gite.
b) If the stay is shortened, the price of the rental remains with the owner. No refund will be made.
Article 6 – Cancellation by the owner: The owner will pay the Tenant the full amount paid, as well as an indemnity at least equal to that which the Tenant would have paid if the cancellation had been made by the owner on that date.
Article 7 – Arrival : The tenant must arrive on the day specified on the present contract from 5 pm.
Article 8 – Payment of the balance: The balance of the rent is paid one week before the entry in the places or on the spot as of the entry in the places if the reservation is concluded by e-mail.
Article 9 – inventory of fixtures: An inventory is established jointly by the tenant and the owner or his representative on arrival and departure of the gite. This inventory is the only reference in case of dispute concerning the state of the premises.
The gîtes will be clean on arrival and must be returned in the same state of cleanliness at the end of the stay by the tenant. The amount of any cleaning costs is fixed at 30€ for a stay of 48 hours and 50€ beyond that.
Article 10 – Deposit: On arrival, a deposit of 300€ may be requested by the owner, particularly for long stays. After the contradictory establishment of the inventory of fixtures at the end of the stay, this deposit is returned, after deduction of the cost of repairing the premises if any damage is found.
Article 11 – Use of the premises: The Tenant must ensure the peaceful nature of the rental and use it in accordance with the purpose of the premises. It is strictly forbidden to hold parties. The Gîtes are also “non-smoking”.
Article 12 – capacity : The present contract is established for a maximum capacity. If the number of tenants exceeds the capacity, the owner may refuse additional persons. Any modification or breach of contract will be considered at the client’s initiative.
Article 13 – Animals : Not allowed.
Article 14 – Insurance : The tenant is responsible for all damages caused by him. He must be insured by a holiday insurance contract for these different risks, see civil liability insurance covering his own responsibility and that of the persons accompanying him.
Article 15- Litigation: Any complaint relating to the state of the premises and the state of the description at the time of a hiring, must be made with the owner of the Gîtes du Couesnon within 3 days. The court of Avranches is competent in terms of disputes.
